CONTRACT

 
         
     
kábisá-LuxHeavenS, hereinafter referred to as "The Agency", acts solely as booking agents on behalf of its owners.
The contract entered into is between the owner of the holiday accommodation and the holidaymaker hereinafter referred to as "The Guests".
The contract is not effective until required payment has been received and confirmation has been sent to the Guests.

Low: September 16th to December 19th,2004  September 16th to December 19th,2005
January 11th to February 8th,2005  January 11th to January 27th,2006

MINIMUM STAY

 
         
     
Low Season:                     5 – 7 nights (unless previously arranged otherwise)

MAXIMUM CAPACITY

 
         
     
kábisá-LuxHeavenS reserves the right to refuse any booking if the number of persons occupying the Villa is exceeding the numbers below, i.e.:
2BR Villa        equals to       4 adults +/ 1 child under 12 years old
2.5BR Villa      equals to       5 adults +/ 1 child under 12 years old
In some villas – due to the size of the bedroom(s)/amenities/facilities placed inside the bedrooms or other reason(s) – there is a limitation regarding the use of an Extra Bed. However, for the villas that allows one/more Extra Bed, it is available at an additional charge of us$25-100/bed/night – depending on the respective Villa. Extra Bed is valid for 1pax/bed.
 
         
     
CHECK IN &/ OUT PROCEDURE
 
         
     
C/I Time:       1pm onwards – unless previously arranged otherwise
C/O Time:      3pm – maximum
Late C/O:      3 – 6pm = 50% of Nightly Rental
6pm onwards = Full Nightly Rental.
 
         
     

RENTAL RATE

         
     
Rental Payments normally cover all Daily American/Continental Breakfast, Daily Laundry – at certain amount as noted above, Airport Transfers (Pick Up and Drop Off), government tax, registration fees, maid, cook etc.
However, there are certain villas that operate on different set of rules of which the Agency will specifically note in the inquiry info/booking confirmation.
NOT included in the letting fee are the Guests’ consumption of Food and Beverage, Extra Laundry & Dry Cleaning, and Telephone which costs’ must be settled prior to their departure.
Gratuities for household staff are encouraged and normal, but shall be left to the Guests' discretion.
 
         
     

TAX & SERVICES

         
     
At all hotels in Indonesia, a standard 10% Government Tax and a 11% Service Charge are levied. However, when renting the majority of private homes or villas, there are currently no taxes, surcharges, hidden costs, staff salaries, service fees, or management fees, outside or above the price quoted. All are fully inclusive in the price.
 
         
     

PROVISIONS & STAFF

         
     
All villas we represent have a minimum of two domestic household staff.
All our properties are fully equipped with bed linens, towels, cooking utensils etc.
In most cases a selection of basic provisions (otherwise referred to as the ‘starter pack’) shall be supplied at the start of the rental. In discount situations often times this will be an extra cost. As such items require replacing, the cost shall be borne by the Guests.
 
         
     

PAYMENT TERMS

         
     
To confirm your booking, kábisá-LuxHeavenS must receive a deposit of 50% of the total letting fee within three (3) working days after invoice and payment instructions have been submitted to the Guests, unless previously arranged otherwise.
All bank & correspondences charges applicable to a telex transfer shall be borne by the Guests.
All payments must be paid in US Dollars. kábisá-LuxHeavenS will NOT accept any payment in other currencies or by traveler / personal cheques.
Any payments by credit cards (ONLY Visa and Master accepted) will be subjected to a 3%-4% additional charge.
Please be aware that Indonesian banks up to this stage are yet able to charge US Dollars direct from credit cards, therefore, to avoid problems caused by the currencies’ difference, kábisá-LuxHeavenS will have to charge an additional fee on top of the total amount invoiced.
 
         
     
Balance / Final payment is required:
ALL Seasons:                                        21 days prior to arrival,
Christmas Booking:                                 60 days prior to arrival.
 
Last Minute Booking:
2 Weeks (14 Nights) prior to Arrival:          7 days prior to arrival – Full Payment
1 Week (7 Nights) prior to Arrival:             Immediately – Full Payment.
 
         
     
CHANGES TO BOOKINGS
         
     
A US$100.00 administration charge will apply to each change after a booking has been confirmed.
Changes cannot necessarily be accommodated in all cases.
 
         
     

CANCELLATION TERMS

         
     
If a deposit is NOT received IN TIME it will result in the cancellation of your booking.
In the case of last minute bookings where The Guests have confirmed a booking with kábisá-LuxHeavenS but the deposit and/or final payment has yet to be received, the Guests is still responsible for the cancellation fee.
 
         
     
Deposits will be refunded in full less:
Administration Fee              USD$100.00
1 (One) Night Letting Fee:   depending on the Villa Rate(s)
Nightly Letting Fee charged on the cancellation of the booking is based on the Contract Agreement between kábisá-LuxHeavenS and the Guests unless previously arranged otherwise.
The above applies ONLY if the reservation is cancelled:
ALL Seasons:                     30 days or more prior to booking dates/arrival
Christmas Booking:             70 days or more prior to booking dates/arrival.
 
         
     
All bank & correspondences charges applicable to a telex transfer refund shall be borne by the Guests.
Reservations cancelled less than the above terms are subject to forfeiture of deposit.
Please be aware that we have to compensate the time and effort involved in making a booking and to compensate the owner from the loss of other potential bookings that have turned down once a booking has been confirmed.
However, should we be able to find a replacement reservation following a cancellation, any monies already paid may be applied towards another reservation at another suitable date, unless previously arranged otherwise.
kábisá-LuxHeavenS must receive Notice of Cancellation in writing.
Final payments are NON-REFUNDABLE.
 
         
     

PLEASE BE AWARE THAT

         
     
Any parties/functions exceeding the maximum capacity of the villa complex (6 BR = 12 adults & 3 children) and which require external catering as well as Banjar’s permission, MUST BE authorized by kábisá-LuxHeavenS when making the reservation.
Please note that kábisá-LuxHeavenS is prohibiting any event/function, which involves any DJ.
 
         
      Additional fees applicable are:  
     
1. Wedding / Function Organizer
Please be aware that kábisá-LuxHeavenS are specializing in villa rental (accommodation) only, therefore, we strongly recommend for any Guests who plans to hold a function / event to hire a specific organizer in order to guarantee a more professional arrangement.
kábisá-LuxHeavenS has extensive relationship with the best organizers around the island. If you prefer us to give you recommendations, we would be glad to assist.
 
     
2. Catering / Food & Beverages
As the service above (organizer) kábisá-LuxHeavenS would also be glad to recommend the best caterers around the island for your event.
 
     
3. Banjar Fee
Please be aware that kábisá-LuxHeavenS will negotiate the amount for this fee with the relevant Banjar based on the relevant event and amount of people.
This fee will then be informed prior to the confirmation of the booking and will then be paid together with the deposit &/ balance payment(s).

The Guests who stay at the villa(s) will be asked to sign a Waiver of Liability Form on arrival day of which stating that the relevant Guests will be fully responsible for any damages or loss that the Guests’ incur while staying at the villa.
 
Security deposits are required for each respective villa which is to be paid on arrival and will be refunded in full on day of departure, unless damages/repairs need to be performed, in which case refunds will be made by Cash or Telex Transfer (T/T), less cost of damages.
 
Credit Card Authorization Form is required if the above security deposit is not paid on arrival, which will allow kábisá-LuxHeavenS to charge the card for damages and any charges that Guests incur while staying at the villa.
 
If for some reason that the bank refuses credit card transaction and/or damages incurred by the Guests exceeds that amount, The Guests will still be held responsible for those damages and payment method will then be a cash payment.
 
We recommend travel insurance to cover you against cancellatin, loss of deposit, baggage and medical emergencies. Some of the villas, due to their proximity to the sea/cliff-top/hill, and like many parts of South East Asia have many hazards and dangers.
 
Under the circumstances and to the extent permitted by law, kábisá-LuxHeavenS DO NOT accept liability in the event of damage, loss or injury to persons or property at the villa(s) or during their rental period arising from any cause whatsoever.
 
In payment of the rental amount, all Guests who enter the kábisá-LuxHeavenS villas are hereby notified kábisá-LuxHeavenS has inherent dangers and all Guests acknowledge that they enter the villas at their own risk.
 
If the Guests consider that he/she has cause for complaint concerning any matter at any of kábisá-LuxHeavenS villas, the matter should first be taken up with the owners or kábisá-LuxHeavenS.
 
kábisá-LuxHeavenS WILL NOT entertain claims lodged by Guests upon departure or after return home when it is no longer possible to investigate the complaint effectively.
